William Balfour, the accused murderer of singer Jennifer Hudson’s mother, brother, and nephew, will not testify in his own defense, said his attorney on Tuesday. The prosecution will rest after a week-long court battle, presenting circumstantial evidence and several testimonies, as there were no eyewitnesses to the murder.

While it’s not been determined, it’s expected the defense will present a brief argument and possibly present witnesses to weaken the case that’s been built against Balfour. In an attempt to bring the case to a close, Balfour’s lawyer, Amy Thompson asked the judge to dismiss the charges brought against her client, saying the evidence that’s been presented is only circumstantial and that the prosecution brought no direct witnesses to the stand.

The judge denied the request. Closing arguments in the trial could happen Wednesday. Jurors would then begin deliberations.
