In  a case that has some similarities to the death of Trayvon Martin, a 13-year-old unarmed teenager was shot and killed in Milwaukee, WI last month.

Police have charged 75-year-old John Spooner with one count of first-degree intentional homicide and one count of use of a dangerous weapon  after he allegedly shot and killed 13-year-old Darius Simmons in front of his home.  A $300,000 bond was set for Spooner.

According to police, Spooner and Simmons were next door neighbors.  Spooner’s home had been burglarized and one day he confronted Darius about the break-ins.  While standing outside with his mother explaining to Spooner that he was in school during the time of the crime Darius was shot and killed…YUP…Spooner pulled out a 9mm and shot Darius in the chest at point blank range.  After getting shot in the chest Darius attempted to turn and run away, and Spooner fired two more shots that missed.  Darius’ mother Patricia Larry watched in horror as her son was gunned down in cold blood.

When police arrived at the scene, they decided to put Darius’ mother in the back of the car and question her for two hours instead of allowing her to ride with her son’s body to the hospital.  Also, while police were searching Larry’s home they did not find anything useful for their investigation.  What they did do was arrest her other son for having truancy tickets.

At the moment Spooner is still incarcerated.  Unlike Florida Milwaukee does not have a “stand your ground” law, so lets hope that justice will be served swiftly in this case.
